KUALA LUMPUR: Parti Pribumi Bersatu Malaysia (Bersatu) Youth chief Wan Ahmad Fayhsal Wan Ahmad Kamal has been accused of lodging a “false police report” against DAP chairman Lim Guan Eng and Prime Minister Datuk Seri Anwar Ibrahim.

Lim, in a statement on Facebook, said Wan Fayhsal had alleged that the former had falsified information, fabricated evidence, and committed criminal conspiracy and slander.

“Wan Fayhsal had clearly committed a crime by lodging a false police report against Anwar and myself regarding the slander by former prime minister and Perikatan Nasional chairman Tan Sri Muhyiddin Yassin, that I had revoked the tax exemption status for the Al-Bukhary Foundation.



“Making a false police report is a criminal offence under Section 182 of the Penal Code.”

He said Wan Fayhsal had claimed in his police report that Anwar was “confused and had confused” the Dewan Rakyat by supporting the fact that Lim had not revoked the tax status of the foundation.

“Wan Fayhsal is wrong to try to bring Parliamentary proceedings to the police.

“He clearly does not respect and understand the principle of the supremacy of Parliament in our Federal Constitution,” the Bagan member of parliament said.

The police or any branch of government has no authority to intrude or investigate matters discussed in Parliament, said Lim, adding that Parliamentary matters could only be decided by Parliament.

It was reported yesterday that Wan Fahysal, representing Bersatu’s Armada movement, had filed a police report demanding both Anwar and Lim to be investigated over Al-Bukhary Foundation’s tax exemption status.

He claimed that Anwar had misled the Dewan Rakyat by backing Lim, and had left out important details about the alleged revocation of the foundation’s tax exemption status when Lim was finance minister in the then Pakatan Harapan administration.

Lim said Anwar had told the truth when he said Finance Ministry records had shown that the former, as finance minister from May 2018 to February 2020, had not revoked Al-Bukhary Foundation’s tax status.



He said Anwar was also right by saying that the cancellation of the tax exemption was in the hands of the Inland Revenue Board director-general and not the prime minister or finance minister.

“Wan Fayhsal then cited Section 44(6B) of the Income Tax Act 1967 as proof that what Anwar said was wrong.

“But Wan Fayhsal showed his ignorance and shallowness of knowledge about economy, finance or taxation when Section 44(6B) referred to the appeal to the minister and not the minister initiating cancellation of tax exempt status.”

He reiterated that he had not seen the Islamic charitable organisation’s files and was not in the position to decide any appeal because none were made by the foundation to himself.

“If there was any revocation, then it could have been made when Muhyiddin was prime minister.

“Wan Fayhsal should persuade Muhyiddin to show proof such as cancellation letters from myself to Al-Bukhary Foundation. If Muhyiddin fails to do so, then both Muhyiddin and Wan Fayhsal have made baseless and false accusations.”
