Govt respects Federal Court’s decision on MACC probe against Nazlan
PETALING JAYA: The government respects the Federal Court’s decision and Chief Justice Tengku Maimun Tuan Mat’s considerations regarding the Malaysian Anti-Corruption Commission’s (MACC) investigation against Justice Nazlan Ghazali, says Anwar Ibrahim.
“MACC is an independent body and has the right to conduct an investigation against any party.
“On the other hand, the procedure set for the judicial body is to refer to the code of ethics for judges if there is a solid basis,” the prime minister told Bernama after the Ihya Ramadan programme at Masjid Putra today.
On Feb 24, a seven-member panel of the Federal Court ruled that the investigation conducted by MACC against Nazlan was done without regard for judicial independence and protocols.
“Investigative bodies like MACC must consult the chief justice before (initiating) the probe. Their failure to inform shows that there was a lack of bona fide on their part.
“The announcement (made by MACC through the media) is enough to damage the judicial institution.

“Investigative bodies cannot publicise an investigation against a superior court judge of their own accord without the chief justice’s approval,” Tengku Maimun said following the unanimous decision by the court.
The ruling was made on a suit brought by three lawyers to challenge the investigation by MACC into claims of an unexplained sum of more than RM1 million in Nazlan’s bank account.
Lawyers Haris Ibrahim, Nur Ain Mustapa and Sreekant Pillai claimed that the investigation was a violation of the independence of the judiciary and the principle of separation of powers.
On July 28, 2020, Nazlan convicted former prime minister Najib Razak on charges of abuse of power, criminal breach of trust and money laundering involving RM42 million belonging to SRC International, which had been deposited into the former prime minister’s bank accounts.
Najib was sentenced to 12 years’ jail and a RM210 million fine.
Nazlan is currently a Court of Appeal judge.
