ALOR STAR: An opposition lawmaker today told the State Assembly that Kedah has the right to charge Penang for raw water extracted from Sungai Muda.

Datuk Phahrolrazi Mohd Zawawi (PH-Alor Mengkudu) said this while asking about the status of a panel of lawyers appointed by the state government last year to manage demand from Penang for raw water usage.

“What happened to the demand for raw water charge to Penang? I heard there was a panel of lawyers. What is the status?



“To me, it is reasonable for Penang to pay Kedah (for raw water). We have to preserve the forest (water catchment), the river has to be maintained. All these incur costs.

“However, I am aware that there is no provision from a legal perspective (to impose the charge),” he told the House while debating the motion of appreciation for the Sultan of Kedah’s royal address during the opening of the state assembly meeting.

The former state Parti Amanah Negara chairman pointed out that the demand was reasonable since even Kedahans have to pay for water consumed in the state.

“They (Penang) should be paying because we (Kedah) are shouldering the cost of preserving the forests and the rivers.



“Even our people are paying for water. Sada (state-owned Syarikat Air Darul Aman Sdn Bhd) has to pay (for extracting water from the river).

“Suddenly, other people are taking the water without paying. Hence, what happened to the (legal) panel?” he asked.

In January last year, Menteri Besar Datuk Seri Muhammad Sanusi Md Nor announced that his administration had appointed a panel of lawyers to manage the RM50 million claim from Penang for raw water extracted from Sungai Muda.

Penang had brushed off the demand, claiming that it was not obliged to pay Kedah for extracting raw water from Sungai Muda which originated from the Ulu Sungai Muda water catchment in Kedah.



Penang Water Supply Corporation (PBAPP) chief executive officer Datuk Jaseni Maidinsa was reported as saying raw water extraction by PBAPP was being done on Penang’s side of the Sungai Muda river, based on the Kedah and Penang Act (Border Amendment) 1985 which did not require charges imposed for extracting raw water.

In response to Sanusi’s announcement on the formation of the panel of lawyers to manage the claim, Penang Chief Minister Chow Kon Yeow had said Penang was ready to face Kedah in court to resolve the issue.
