In March, Kepong MP Lim Lip Eng was ordered to pay RM2 million to businesswoman Jessy Lai and her company MonSpace after he was found liable for libel.

PUTRAJAYA: A RM2 million award to the founder of an e-commerce firm in a defamation suit will be transferred to her lawyer as a stakeholder, pending the outcome of Kepong MP Lim Lip Eng’s appeal against the High Court’s decision.

Lim’s lawyer, Guok Ngek Seong, said the parties recorded a consent order before a three-member Court of Appeal bench chaired by Kamaludin Said in a stay of execution proceeding.

“I will transfer the money to the respondents’ lawyer to be kept in the client’s account, pending the disposal of Lim’s appeal by the appellate court,” he told FMT.



Kamaludin, who sat with Justices Hashim Hamzah and Wong Kian Kheong, also ordered Lim to pay RM2,000 in costs to businesswoman Jessy Lai.

Guok said the appellate court had yet to fix an appeal hearing date.

On March 16, the Kuala Lumpur High Court ordered Lim to pay a total of RM2 million to Lai and MonSpace (M) Sdn Bhd after he was found liable in a libel suit.

The DAP leader obtained an interim stay of judgment from the Court of Appeal on May 26, pending the outcome of today’s proceeding.

Lim had said there was a great risk that he would not be able to recover the judgment sum if it was paid to the plaintiffs should the Court of Appeal subsequently allow his appeal.

He managed to crowdfund slightly more than RM2.25 million, which his lawyer was holding as a stakeholder.



Justice Akhtar Tahir had allowed Lai’s suit against Lim over statements the MP made about her and MonSpace in 2017, and also ordered that the damages be paid immediately.

Lim was ordered to pay general damages of RM500,000 to Lai and RM1 million to MonSpace. He was also ordered to pay them another RM500,000 in aggravated damages.

Akhtar said he found Lim’s actions akin to those of a “vigilante” who was determined to force the authorities to act against Lai and her company at any cost.

He also said the RM2 million in damages was to serve as a deterrent against anyone who made unfounded remarks.



In her suit, Lai said Lim had tarnished her reputation and that of her company by accusing them of running an illegal business and cheating Chinese investors.

She said the MP’s statements, published by the English and Chinese media, implied that she was a dishonest person.
