The Court of Appeal substituted the 12-year jail term imposed on Chong Chon Lang by a lower court with a term of one year.

PUTRAJAYA: The Court of Appeal has upheld the conviction of a woman on two charges of exploiting her foreign maids by making them work without pay for her house-cleaning business.

However, the three-member bench led by Justice Hanipah Farikullah substantially reduced Chong Chon Lang’s sentence and acquitted her husband, Low Kee Pat, of the same charges.

Also on the bench were Justices See Mee Chun and Azman Abdullah.

Chong was convicted under Section 12 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007.



However, the court substituted the 12-year jail term imposed on her by a lower court with a term of one year.

Hanipah said Chong had exploited her Indonesian and Cambodian maids by making them perform work for her house-cleaning business without paying them.

“The wife’s action falls under the definition of exploitation,” she added.

However, the court acquitted Low after finding no evidence to suggest he participated in the exploitation.



The couple and their children were seen crying after the decision was handed down, with Chong waving to them as she was being taken into custody.

The duo were initially found guilty of the offences by the Shah Alam sessions court on Jan 10, 2019, and were each sentenced to 12 years in prison.

The High Court upheld their conviction and sentence in 2020.

Earlier today, the couple’s lawyer Sreekant Pillai argued that the prosecution had failed to prove the exploitation charges.



He said the maids had received their salaries on time and were not harmed in any way during their employment.

Meanwhile, deputy public prosecutor Aznee Salmie Ahmad said that under the terms of their employment, the maids were only supposed to work in the couple’s house.

Despite this, Aznee said Chong forced them to clean the houses of her clients and collected cleaning fees without offering any payment to the maids.
