The plaintiffs are challenging the authenticity of Sarawak governor Abdul Taib Mahmud’s signature on a document as they seek an injunction against Raghad Kurdi Taib.

PETALING JAYA: Sarawak governor Abdul Taib Mahmud’s sons have applied to the court for their father to be named third defendant in a bid to secure an injunction against their stepmother, Raghad Kurdi Taib.

Siblings Sulaiman Abdul Rahman Taib and Mahmud Abu Bekir Taib earlier named Raghad and RHB Bank Bhd as first and second defendants, respectively.

Alvin Chong, lawyer for the brothers, filed the application when the matter came up for mention on Nov 6.



According to The Borneo Post, Chong raised the application during proceedings in the Kuching High Court before Justice Alexander Siew today.

It was reported in June that the plaintiffs were seeking an injunction to prevent the transfer of shares in a private company, Cahya Mata Sarawak Group, to Raghad.

Sulaiman, a former deputy tourism minister, is managing director of Cahya Mata Sarawak.

In October, the plaintiffs challenged the authenticity of Taib’s signature on a document related to the transfer of shares.
Opposing the application, Raghad’s counsel Shankar Ram referred the court to a supplementary affidavit by Taib showing that the shares were given to Raghad.

“Tun (Taib) clearly stated that the document was indeed signed by him,” said Shankar.

He said thereafter, the plaintiffs had filed affidavits of two experts to challenge Taib’s signature that was deposed before a commissioner of oaths in the High Court.

Shankar also referred the court to Articles 1, 10 and 44 of Sarawak’s constitution which prohibits proceedings from being brought against the governor in his personal capacity. An exception would be if the case was brought in a special court with the chief justice being the presiding judge.

He also said the plaintiffs had not sought the consent of the attorney-general to institute proceedings against the governor.
